How do you avoid probate on a home?
Here’s some suggestions for you.
Make a Living Trust. I can’t stress it enough. The way to avoid probate is simply to create a living trust.
Name your beneficiaries on all retirement, bank accounts and other accounts that pertain.
File Joint Tenancy with a Right of Survivorship. If you have questions about this let me know.
Wills do not have to go through probate unless you want to transfer ownership of assets owned by the testator, or the person who wrote the will, to her/his living beneficiaries. Some states provide legal options for doing it through simplified procedures for limited estates.
What needs to go through probate?
Assets that generally do not go through probate are, Firstly, jointly owned assets that transfer to the surviving owner; Secondly, assets that have a valid beneficiary designation; and then Thirdly assets that are in a trust. However, these assets do not always avoid probate.
Probate is the court-supervised process of the gathering of the deceased person’s assets and distributing them to creditors and inheritors. If you are the executor, your probate process will depend on if your state has adopted the Uniform Probate Code (UPC), which is a set of probate laws written by a group of national experts.

People obviously do not always appear as they truly are. What profession are you involved with? Are you secure in knowing what you’re doing or do you just BS your way through your day?
I am a Professional Realtor, one who is experienced, honest, ethical, educated and fun to work with. What I’d like you to know is that there are so many agents with their license who have no clue what they are doing OR don’t care. If I had a dollar for every time I’ve met someone and they said to me, I wish I would have known you when we were buying our house. Our Realtor SUCKED, Our Realtor was horrible. I would be retired by now.
Let me please implement the importance of interviewing your agent. Do NOT feel guilty by not choosing them. Move on until you find the right match. Let me handle all the stress of the transaction cause there is stress but my buyers and sellers seldom now because I don’t pull them into it.
Don’t hire someone who does this profession part-time. Unless, that’s what you want someone who’s going to perform 1/2 of the time.

GENSMART LAS VEGAS HOMES
As life evolves as things always continue to change this is something a little bit new to the market. It’s called the GenSmart Suite. Many times people chose a casita for extra guest/rooming space. Maybe people like the idea of renting out the casita and making a little income. Perhaps they have family members who are visiting for a long stay. Maybe they have a family member who needs a place to live. As we mature we need less space and actually don’t want the responsibility of having or owning a big home anymore.
How about the college student that needs a little more privacy? Or, the newlywed couple who needs to save up a little money before they can buy their own place.
A GEN Smart Suite is perfect. As you can see in the video it’s all a person really needs. There’s a double sink, very nice kitchen area, a spacious living area and wonderful bedroom area. I was almost ready to just move into this place. Of course I couldn’t because it’s a model home and the new home builder may wonder what I’m doing.

This is a very serious blog. I can not begin to tell you how many stories I’ve heard about people being scammed by someone acting as a Realtor, is a Realtor or homeowner who’s gonna rent their place out. There are some really horrible people scamming others. Here’s a couple of examples:
One Licensed NV Realtor was managing rentals for many landlords. What he was doing was receiving the rent monies and not paying the landlords saying that the renters were late on payments etc. He got away with this for months. Taking the rent checks and putting the money in his pockets. He did eventually get caught and return to his country never to be found. He was fined by the NV Real Estate Division, but I’m quite sure non of the landlords and the RE Division will never be paid back. The payments in fines were over $100,000. I can’t remember the exact amount. Heck maybe it was near $300,000. Seriously, How can someone do that to others?
How about all the people who scam people off of CL and lots of other websites. I have heard stories of People posing as Real Estate Agents. Sending the lease agreement and collecting money, NEVER to be heard from again… YOU CAN NOT trust all Realtors. Please read below:

Google the agent, www.http://SunnyLasVegashomes.com or
Call their office number, check to make sure there is an agent by that name affiliated with them.
Call GLVAR and see if they have a Realtor by that name
Keep Checking, DO NOT STOP until you know in your gut that you are dealing with someone you can trust.

Here’s what I see happening in the Las Vegas housing market, grant you this is my opinion formed from selling Real Estate full-time in the Vegas Valley for over 16 years.
Things are kinda sideways and a few people are scrathing their heads saying hey what’s going on with the FIRTA clause when buying and selling in Vegas. First of all, like any industry there tends to be trends. You know a flow, prices go up then they drop. Well, I’ve seen something escalating and that is sellers selling their property with the FIRTA clause. What is FIRTA? Foreign Investment in Real Property Tax.
FIRTA is the disposition of a United States Real property interest by a foreign person (the transferor) is subject to the Foreign Investment in Real Property Tax Act of 1980 (FIRPTA) income tax withholding. FIRPTA authorized the United States to tax foreign persons on dispositions of U.S. real property interests.
A disposition means “disposition” for any purpose of the Internal Revenue Code. The meaning of disposition is similar to the action of distributing or transferring property or money to someone, in particular which may include but is not limited to a sale or exchange, liquidation, redemption, gift, transfers,. So buyers purchasing United States real property interests (transferees) from foreign persons, certain purchasers’ agents, and settlement officers are required to withhold 15% (10% for dispositions before February 17, 2016) of the amount realized on the disposition (special rules for foreign corporations).
In a majority of cases: the transferee/buyer is the withholding agent. If you are the transferee/buyer you must find out if the transferor is a foreign person. If the transferor is a foreign person/persons and you fail to withhold, you may be held liable for the tax. For cases in which a United States business entity such as a corporation or partnership disposes of a United States real property interest, the business entity itself is the withholding agent. I know this gets a little bit confusing and or complicated.
Here in Las Vegas it’s handled through the title company. Thank goodness they are on top of the changing Las Vegas market.
FIRTA in Las Vegas is on the rise. I am guessing it is throughout the U.S. I have had several buyers buy from FIRTA sellers. The buyer in most cases is required to sign a form stating they will live in the home for 2 years.
This means a big deal when it comes to investors purchasing properties. Cause in my understanding , they can’t buy these properties. So, they are limited to what’s out there for sale that aren’t FIRTA sales and our INVENTORY is so Low. How low can it go?.

We just had another successful closing of a wonderful 2 bedroom home here in Las Vegas. It is in a gated community that has a playground. It was almost completely remodeled. Paint from the floor to ceiling. Brand new flooring throughout. Pretty decent sized backyard. Very close to the gym, grocery stores, restaurants, gas stations and the 215. It sold for $150K Very nice price for a home here in Sunny Las Vegas.

It’s been a couple of days since my last blog. I really have no excuses. Happy Mother’s Day to all the women and or men that play the mom roll in children’s lives.

See, it’s a simple search. Take a guess at how houses there are for sale? Ready for the answer? 29 , Yes, only 29 homes. Some are short sales, some are foreclosures, and some are Traditional sales.
