Hello everyone,

When I first got into Helping clients buy and sell homes I thought to myself, It’s really important to remember how much work it can be to move.  So many of us move in a home and stay set.  As one lady said to me the other day, I’m never moving again, she was probably in her late 50’s and just has had enough moving around.  She said I’m going to die in this house.  Which of right now we don’t have to disclose if someone dies in a property.

My point of this blog is, I just moved.  It was a great experience.  I don’t have a lot of things, I am a minimalist.  I will say tho,  even as a minimalist, it’s a lot of work moving.  If you need information about Las Vegas Real Estate, homes for sale, or are interested in selling, Please give me a call, I’ve been helping clients buy and sell homes in Las Vegas for over 17 years full-time.

Las Vegas HOA’s:: CIC’s what are they? Are they a benefit? Pros and Cons

Hi there,

HOA’s what are they and why are they so popular in Las Vegas?  If you are moving from the Midwest and other areas of the world that don’t have HOA’s you’re probably wondering what they are and why are they important or not important.  To begin with HOA stands for Home Owners Association.  Another term for HOA is CIC, Common Interest Community? Here is the NV Law that gives the meaning:

1.  In the case of:

      (a) A condominium or cooperative, all portions of the common-interest community other than the units, including easements in favor of units or the common elements over other units.

      (b) A planned community, any real estate within a planned community which is owned or leased by the association, other than a unit.

      2.  In all common-interest communities, any other interests in real estate for the benefit of units’ owners which are subject to the declaration.

     In other words when you purchase a home that is within a CIC you will receive a Re-Sale package that explains the rules and by-laws within the community.  For example:  it may state, when you can hang your Christmas lights, how long you can set your trash out and when and where the trash can needs to be.   It may state you can’t paint your house purple.  What type of landscaping you can have. What type of lighting you can install. Where you can park or not park. Many but not all CIC’s are in gated community so you have rules about how the gate code is given out or not given out.  Many CIC’s are rules.

In communities that don’t have HOA rules, you more than likely can hang your Christmas lights all year long.  You can work on your car in the driveway, you can park RV’s or boats on the street.  In essence, you can do most anything you want and not get a warning or fined.

I moved here from Iowa and respectfully you cared about your property and how your neighbors are living in due respect to all of the community.  The city may have had a few restrictions but all in all there weren’t many rules.

Many people are happy to live in community with HOA’s.  Many people are not.  It’s all about what is important to you.  If you live within a HOA community you do not have the rights to change or go against the grade.  You will not probably succeed at changing things.

If you are warned by the HOA to example: pull your weeds from the front yard or pressure wash the oil off your driveway I recommend doing what they ask.  If not, you will be warned again and more than likely fined.

Many People who buy in HOA communities don’t realize that the HOA board members live in that community so they are somewhat policing the community.  They are looking for violations of the homeowners.  Some board members take this responsibility to the max and absolutely nit pick at homeowners to the point of annoyance and harassment.

I had at one time sold a condo to a client who loved the area, loved the complex but many of the board members took their position very seriously and in lack of a better way to explain were very terrible to the people who lived within the complex.  Needless to say My client asked me to sell his condo for him because he could not stand the HOA board members harassments.

When living in a HOA community you will have fees to pay. Most every HOA is different in their monthly fee, quarterly fee or yearly fees.

FIRTA, what is it? Las Vegas Inventory

Here’s what I see happening in the Las Vegas housing market, grant you this is my opinion formed from selling Real Estate full-time in the Vegas Valley for over 16 years.

Things are kinda sideways and a few people are scrathing their heads saying hey what’s going on with the FIRTA clause when buying and selling in Vegas.  First of all, like any industry there tends to be trends.  You know a flow, prices go up then they drop. Well, I’ve seen something escalating and that is sellers selling their property with the FIRTA clause.  What is FIRTA?  Foreign Investment in Real Property Tax.

FIRTA is the disposition of a United States  Real property interest by a foreign person (the transferor) is subject to the Foreign Investment in Real Property Tax Act of 1980 (FIRPTA) income tax withholding. FIRPTA authorized the United States to tax foreign persons on dispositions of U.S. real property interests.

A disposition means “disposition” for any purpose of the Internal Revenue Code.  The meaning of disposition is similar to the action of distributing or transferring property or money to someone, in particular which may include but is not limited to a sale or exchange, liquidation, redemption, gift, transfers,.  So buyers purchasing United States real property interests (transferees) from foreign persons, certain purchasers’ agents, and settlement officers are required to withhold 15% (10% for dispositions before February 17, 2016) of the amount realized on the disposition (special rules for foreign corporations).

In a majority of cases: the transferee/buyer is the withholding agent. If you are the transferee/buyer you must find out if the transferor is a foreign person. If the transferor is a foreign person/persons and you fail to withhold, you may be held liable for the tax. For cases in which a United States  business entity such as a corporation or partnership disposes of a United States real property interest, the business entity itself is the withholding agent.  I know this gets a little bit confusing and or complicated.

Here in Las Vegas it’s handled through the title company.  Thank goodness they are on top of the changing Las Vegas market.

FIRTA in Las Vegas is on the rise.  I am guessing it is throughout the U.S.  I have had several buyers buy from FIRTA sellers.  The buyer in most cases is required to sign a form stating they will live in the home for 2 years.

This means a big deal when it comes to investors purchasing properties.  Cause in my understanding , they can’t buy these properties.  So, they are limited to what’s  out there for sale that aren’t FIRTA sales and our INVENTORY is so Low.  How low can it go?.

Just another learning curve for the general public and everyone involved in the Housing market knowledge department.
